SOME FUNDAMENTAL POSTULATES GOVERNING RELATIONS BETWEEN MONETARY (BANKING) FINANCES AND MONETARY LAW
Abstract
The connection between science of monetary law and science of monetary financesis so significant that in today’s economic and social developments it transcends thevery concept and the dialectic of multidisciplinarity and its function and receives adistinctly pragmatic component, which no longer only concerns the actuality andbroader understanding of the concept of multidisciplinarity between legal andeconomic disciplines This link also emerges as an important determinant of themodern standard of living in which homoeconomicus is personally very interestedin the achieved level of monetary and legal stability. Тhe manner of realization ofmonetary finances in the broadest sense of the word is determined by positive monetarylaw. These regulations are a reflection of the monetary sovereignty of thestate, which in the present circumstances has been transferred to the central bankas the supreme monetary institution, which also emerges as the main guardian ofmonetary prerogatives derived from the structure of monetary sovereignty. Weare of the opinion that all monetary prerogatives prima facie reflect the economicside (dimension) of public law monetary management (governance) if we start fromthe fact that the adoption, implementation, and amendment of monetary law regulationsare the backbone of the legal side (dimension) of monetary management.Only in cohesion and full material and formal consistency of legal and economicdimension monetary management can affirm, strengthen and valorize its values.
