**Predvidljivost i ograničenje ugovorne štete u rimskom pravu**

Sažetak


Ovaj članak proučava ograničenje odgovornosti za ugovornu štetu u rimskom pravu kako bi ispitao da li je koncept predvidljivosti u ugovornoj šteti formiran u rimskom pravu i kakav je njegov uticaj na razvoj ograničenja odgovornosti za ugovornu štetu u savremenom pravu. Zaključuje se da su rimski pravnici, iako nije postojalo opšte pravilo, u određenim kontekstima raspravljali o ograničenju ugovorne štete i da je postojao nejasan nagoveštaj predvidljive štete kao osnove za ograničenje naknade štete. Rimsko pravo postavilo je temelje za pravično ograničenje ugovorne štete, što je postalo inspiracija za razvoj predvidljivosti i ograničenja odgovornosti u ugovornom pravu modernog doba.
